A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his continued detainment is without legal authority.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.

The case stems from a erroneous removal to El Salvador earlier this year, which US authorities later admitted was an mistake. After his return to the United States to face alien smuggling charges, he was held in immigration custody.

In her order, the court noted that the authorities lacks a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
